We Do Exist

It has been more than seven decades of Independent India and still the LGBT community is struggling to acquire equal status in our country and across the world in few countries. In recent days, laws have been passed to streamline and give some weapons to their battle. But, will that suffice.Answer will certainly be negative. This battle is also about acceptance by society and changing the mindset of the people. Recently legislation has passed specific law for Transgender. Now a voice has been raised to amend the Personal laws and Indian Penal code. Their demand is genuine. When they have been recognised as third gender in 2014 by the Supreme court while adjudicating the matter namely National legal service authority Vs UOI, then the legislature must take suo motto effort to amend the relevant legislations to bring the third gender within purview of laws of cour country. The fact that the third gender has to approach the Supreme court with such grievance is not appreciable.

It has been rightly observed by our Apex court while delivering the Judgment in the matter Navtej Singh Johar Vs. UOI WP(Criminal) 76, 2018 that “ History owes an apology to the members of this community and their families, for the delay in providing redressal for the ignominy and ostracism that they have suffered through the centuries. The members of this community were compelled to live a life full of fear of reprisal and persecution. This was on account of the ignorance of the majority to recognize that homosexuality is a completely natural condition, part of a range of human sexuality”.

In Hindi there is a proverb सुबह का भूला अगर शाम को लौट आये तो उसे भूला नहीं कहते . Hope we will fill up the gap soon and take all necessary efforts to bring them on the equal footing with lots of love, affection, care and most importantly with respect.
